  1. I dont find the right answer at the internet so mb you can help me; do you actually still pay for blizz even if using a private server (which is for free himself)? Or is it completely for free ?

  2. Your analysis is actually incorrect, unfortunately. As a law student and future attorney, terms of service are what we call contracts of adhesion. They are adhesive because they are naturally one-sided and require one party – the consumer – to adhere to their terms or otherwise there may be no contract. This is unlike a typical two-party contract where both sides offer consideration in return for something else. Think of it as a "my way or the highway" sort of deal. Terms of service are very much binding. The only cases where adhesion contracts have been held by courts to be unlawful are when they are "unconscionable" or unreasonable. Or if the consumer was somehow under duress when he or she signed the agreement. Here, it is not unreasonable for a company to expect that they and they alone should receive compensation for their intellectual property.

     Private servers, while they provide better experience rates and expedite progression, are probably unlawful. But just because they are unlawful, doesn't mean they will automatically get shut down. Unless the owners of the intellectual property institute legal action, because it is an action of a civil nature and not criminal, there would be no redress. Until Blizzard decides it is a problem, it will not be a problem. Blizzard most likely contacted the server that ultimately shut down and notified them that they were going to take legal action unless they shut down. I know private servers are fun, but it's really not fair to the original creators if you think about it. Someone spent time creating these concepts, copyrighting them, and building a company to help develop these ideas. What you spend many hours playing is the result of about 10x as much thought and work. The reason most private servers stay up is most likely because the company doesn't see a 50 player server worth it to go after. But if the server starts to siphon a substantial amount of their player base, then certainly they might take action. And they would be legally entitled to do so. A defense of unconscionability or unreasonableness is irrelevant to the issue of theft of intellectual property.

  3. 1 question if the servers not useing blizzards code why does it has same version as wow and addons? :D. I mean as vanilla and other that was back then or even legion. But i dont got prof so yeah.

  5. or think about this, blizzard says that you don't own your account and it's property of blizzard, so people who run a private server are the ones in charge of your account and its not actually yours

  6. My god Blizzard making theyre game so freakin bad and should not gank people who make private servers from older good expansions 😀 those peoples are good blizzard dont do extra older expansion servers its their fault

  7. The fact that they're advertised as World of Warcraft private servers is in infringement on copy right in itself regard less of whether or not code is being used. So it would be illegal for me to open a restaurant in call it McDonald's. And even if it's ignored in core if it's determined by the courts to be infringing on copyright The IP address of the server can be censored by the US government through isp's.

  8. In the US they can give you the death penalty for breaking TOS… Digital Millenium Copyright Act. Every lawyer who has read it says its Unconstitutional but they still put people in prison using it….

  9. So pretty much they care less if you make no money hosting a server, and usually they just shut you down instead of taking it to court good to know. I also heard if your server not popular usually they ignore it and go after the bigger targets.

  10. This has put me on a very interesting train of thought. As a newer player the particular server I play on does not go past a certain expansion. Perhaps Blizzard views this more positively than negatively. WoW is ever expanding and the team behind the development process have done good work to expand on the vanilla game. While I may be stuck playing on an outdated expansion I can say that I have certainly considered committing to the game to see which direction the world takes. So perhaps they have let a few of these 'outdated' servers remain in an effort to entice new players? If the players don't pay for the game after playing it for free Blizzard losses nothing but if they decide to pay for the subscription and product, it's a new player. As long as the they're not spoiling new content I can understand why the servers are allowed to remain.
